Were You a Victim of Insurance Bad Faith?

Posted by Diane Zimmerman | Jul 14, 2022 | 0 Comments

Insurance companies have an obligation to fulfill important duties to their policyholders, and failure to fulfill these duties can amount to bad faith insurance which generally connotes a violation of the implied covenant of good faith and fair dealing. Anybody who believes their insurance company has operated in bad faith will want the help of a Florida property insurance claims attorney.

Bad faith claims involve two types, first-party insurance bad faith claims in which insurance companies unreasonably refuse to pay claims or properly investigate claims, and third-party insurance bad faith claims when insurance companies unreasonably fail to defend, indemnify, or settle claims within policy limits or investigate claims for other parties. Insurance companies will be bound by both common law and statutory law to recognize your claim, investigate the claim in a prompt manner, respond quickly to your communications, not slow down the progression with unnecessary forms, and offer reasons for denial of a claim or delays in the process.

Common Issues with Flood Damage Insurance Claims

Florida Statute § 624.155(1) provides a statutory cause of action for first-party bad faith and states that any person can bring a civil action against an insurance company when the person is damaged by the commission of any of the following acts by the insurer:

  • Not trying to settle claims in good faith
  • Making claims payments to insured parties or beneficiaries that are not accompanied by statements setting forth the coverage under which the payments are being made
  • Except for liability coverages, failing to promptly settle claims when the obligation to settle a claim has become reasonably clear.

Third parties have the right to statutory bad faith claims in Florida under the state's Unfair Insurance Trade Practices Act. Unfair settlement practices outlined in the act include multiple provisions.
