Homeowners' insurance claims can often take far longer to be paid than you would like. The difficulty is that you are often stuck in limbo, needing the check to begin to repair the damage and rebuild.
In some cases, the insurance company is inundated with claims because there was a mass damage event. Usually, these delays happen after significant storms. Even when insurance companies have enough adjusters (which they often do not), they will struggle to process a large volume of claims.
The insurance company may just be poorly run and not have the proper procedures and resources to handle incoming claims. Delays could be the result of sheer incompetence.
The insurance company may be in no particular hurry to pay your claim. They know how much you need the money, and they figure that they can gain leverage in a negotiation by delaying as long as they can. The insurance company may intentionally create a delay by reading requirements into your policy that simply are not there. They may even try to retaliate against you for speaking up too much for your own rights under your policy.
No matter the reason for the delay, the insurance company does not have carte blanche when it comes to responding to claims. If they delay for too long, or they act intentionally to unreasonably slow down your claim, you may file a state law claim against them for bad faith to pay for your own damages that the insurance company caused through their delay.
